Arun, Inc’s services are based on accepted practice and that degree of care and skill customarily followed by reputable members of the profession practicing in this and other similar communities. As such, design studies, calculations, working drawings, specifications, and other documents related to the Project may contain imperfect data, conflicts, errors, omissions, code violations and improper use of materials, which will be corrected by Arun, Inc. when identified. Arun, Inc’s work shall be based on information supplied to him by Client or at Client’s direction.
Liability: In recognition of the relative risks and benefits of the project to both Client and Arun, Inc., the risks have been allocated such that the Client agrees, to the fullest extent permitted by law, to limit the liability of Arun, Inc. and his or her subconsultants to the Client and to all construction contractors and subcontractors on the project for any and all claims, losses, costs, damages of any nature whatsoever or claims expenses from any cause or causes, including attorney’s fees and costs and expert witness fees and costs, so that the total aggregate liability of Arun, Inc. and his or her subconsultants to all those named shall not exceed the Arun, Inc’s total fee for services rendered on this project. It is intended that this limitation apply to any and all liability or cause of action however alleged or arising, unless otherwise prohibited by law.
